KAMAL ORAL ORDER Petitioner is before this Court seeking issue of writ of mandamus directing the respondent -BDA to allot alternate site for having acquired his land measuring 1.1 guntas forming part of land bearing Sy.No.112, situated at Nagadevanahalli Village, Kengeri Holbi, Bangalore South Taluk in terms of the guidelines issued by this Court in the case of JUNJAMMA AND OTHERS VS. BANGALORE DEVELOPMENT AUTHORITY (ILR 2005 KAR. 608) by considering his representation dated 06.08.2019 as per Annexure-G. 2. Case of the petitioner is that he has purchased the aforesaid piece of land in terms of deed of sale dated 01.05.1980. That by a notification dated 19.01.1989 respondent -BDA acquired the aforesaid land for formation of - 3 - NC: 2025:KHC:8689 WP No. 18503 of 2024 Gnanabharathi Layout. That on 05.01.2016 petitioner has filed Form No.1 and has deposited Rs.65,500/- seeking allotment of alternate site. The petitioner made representation on 06.08.2019 seeking alternate site. Even after lapse of three and half decades from the date of acquisition petitioner has neither been allotted any alternate site nor has issued any response to the representation so made. Hence, the petition. 3. Counsel for the respondent -BDA submit given some time and on petitioner satisfying all requirements of the respondent-BDA, case of the petitioner would be considered in accordance with law. 4. Submission is taken on record. 5. Hence, the following; ORDER 1. Petition is disposed of. 2. The respondent-BDA shall consider the representation dated 06.08.2019 produced at Annexure -G of the petitioner after giving an opportunity of personal hearing and if the petitioner - 4 - NC: 2025:KHC:8689 WP No. 18503 of 2024 is found eligible appropriate orders shall be passed in accordance with law. 3.
