1. Instant petition has been filed under Article 227 of the Constitution of India, for setting aside order dated 05.03.2025, Annexure P-4, passed by the learned Civil Judge, Junior Division, Chandigarh, whereby on an application filed under Order 39 Rules 1 and 2, CPC, Court has refused to grant ex-parte ad interim injunction.
2. Counsel for the petitioner has made a reference to judgment passed by a co-ordinate Bench of this Court in Iqbal Singh and others Versus Chanan Singh, 1966 AIR Punjab and Haryana 165 to urge that a revision petition against such an order is maintainable.
3. Be that as it may, it could not be disputed that during the pendency of the instant revision petition, both the defendants have been served and proceedings are pending before the trial Court for 23.05.2025 for the filing of the written statement as well as reply to the stay application. 4. As application under Order 39 Rules 1 and 2 CPC is pending adjudication before the trial Court, this Court deems it appropriate to direct the trial Court to decide the same as expeditiously as possible within a period of two months from the date of communication of a copy of this order.
