Mr. Priyabrata Batabyal …..for the State/respondents The present writ application has been preferred praying for direction upon the respondent authorities being the respondent nos. 2 and 3 herein to carry out and implement the fixation of wages as proposed in the notification and published in the official gazette Calcutta Gazette Extra Ordinary dated February 23, 2024. It is further prayed that the representation submitted by the petitioner dated 5th August, 2024 is still pending disposal and as such the same may be directed to be disposed of in accordance with law. The State has filed a status report as directed. From the report submitted by the Additional Labour Commissioner (P) West Bengal it appears that the State Level Minimum wage advisory Board, in their two successive meetings held on 29.02.2024 and 2 26.09.2024, could not reach any consensus resolution regarding this issue. The concerned authority has further stated that the matter may be further raised before the State Level Minimum Wage Advisory Board for further discussion and for making consensus recommendation to the appropriate Government for fixation and categorization. Considering the said facts, the Labour Commissioner, Government of West Bengal is directed to raise the issue as stated before the State Level Minimum Wage Advisory Board within 7 days from the communication of this order. The Board shall consider the matter including the representation submitted by the petitioner and take a decision in accordance with law within 60 days from the date of the matter being referred before the Board. The Board shall also hear all the stakeholders while taking a decision. In case of the copy of the representation is not available with the authorities, the petitioner is at liberty to file a copy of the same, which shall also be duly considered by the Board. The writ application stands disposed of. Applications, if any, connected thereto stand disposed of consequently. Interim order, if any, stands vacated. 3 Let a copy of this order be sent to the Labour Commissioner, Govt. of West Bengal for immediate compliance. Parties to act on the basis of server copy of this order duly downloaded from the official website of this Hon'ble High Court.
