Campus Police Station, Tirupathi, Tirupathi District, which was regI|Stered for the alleged offences under sections 329(4),109(1),115(2), 351(3) RAN 3(5) BNS & 20(b)(ii)(B) RAV 8(c) of NDPS Act; The petition coming on for hearing, upon perusing the petition and memorandum of grounds of criminal petition and upon hearing the arguments of Sri Veeravalli Venkata Ravi Kumar, Advocate for the Petitioner and public prosecutor for the Respondent; r/ THE HONOURABLE SRI JUSTICE I MALLIKARJUNA RAO CRIMINAL PETITION NO: 3894 of 2025 Order:- i This CrimI-nal PetitI-On, under Sections 480 and 483 of ' BNSS, has been fl'led by the petitI-Oner herel-n/Al seeking regular bail, in CrI-me No.20 of 2025 of S.V.U.Campus Police Station, Tirupathi District, registered for the offences punishable under sections 329(4),109(1),115(2)I and 351(3) read with 3(5) of the BNS. 2. Case of the prosecution, in brief, is that, on o9.02.2025 at about 12.30 AM, in Room No.18, H-Block Hostel, SV Univerisy, TirupatI', Wherein, Al who is staying in Room No.63, H-Block, SV University, Tirupatj illegally by threatening the roommates Kiran and Kumar and he drinks alcohol at every nl-ght in the room and makes inconvenience to his roommates. The complainant said Al to vacate the hostel otherwise he will inform the warden. By keeping the same in mI'nd, Al criminally trespassed into the complainantJs room with his friend A2 by hunting sickle with an intention to kill the complainant and they beat Hari, KI-ran and Raja with hands, kicked with legs. Then, Al attacked the complainant with hunting sickle and caused bleeding injury on his left foot and threatened him wI-th dire COnSequenCeS. -----. try* -_~ •2 3. Heard. Perused the record. 4. Learned counsel for the petitioner submits that the PetitI'Oner has been in judicial custody from 10.02.2025 and most of the I-nVeStigatI'On might have been completed by this time and hence, he prays thI-S Court to grant bail to the petitioner herein. 5. The learned Assistant public Prosecutor submI-tS that five criminal antecedents have been reported against the petitioner, and a rowdy sheet has been opened against him. It is further submitted that the petl-tioner `is not a student and is residing in the hostel illegally. 6. The learned counsel for the petitioner submitted that out of the five crimI-nal Cases registered against the petitioner, two have been compromised, and the remaining three are pending trl-al. lt was further submI-tted that, as per the remand report, the PetitI-Oner I-S Currently pursuing his second year of M.A. in Economics. The learned Assistant public prosecutor submitted that the injuries sustained by the defacto complainant were simple in nature and th?I he was discharged from the hospital. The submission of the learned Assistant public Prosecutor I'ndiCateS that there is n9 danger to the life of the defacto complainant. It is submitted by the learned Assistant public Prosecutor that, as many as 4 witnesses were examined in the present crime and some inore witnesses are to be examin?d. 7. ln view of the aforesaid facts and circumstances Of the case and considering the remand period of the petitioner, this Court is inclined to grant bail to the petitioner herein. 8. Accordingly, the Criminal Petition is allowed. The petitioner herein/Al shall be released on bail on his executing a personal-bond for a sum of Rs.50,000/-(Rupees Fifty Thousand only) with two sureties of the like sum each to the satisfaction of the learned I Additional District and Sessions Judge, Chittoor. On release, petitioner shall appear before the Station House Officer concerned, on 6very alternative day, between 10.00 AM and 05.00 PM, for a period of two (2) months.
