1. Heard Mr. Ghanshyam Patel, learned counsel for the petitioners. Also heard Mr. Hariom Rai, learned Panel Lawyer, appearing for respondents No. 1 & 2/State.

2. The present petition has been filed by the petitioners with the following prayers:
“1. Hon’ble Court may kindly be pleased to quash the impugned FIR No. 62 of 2022 registered as P.S. Mahila Thana Bilaspur on 05.11.2022 for offence under Section 498-A and 34 of the IPC (Annexure P/1).
2. Hon’ble Court may kindly be pleased to quash the final report No. 47 of 2023 dated 17.06.2023 for offence under Sections 498-A/34, 294 and 506 of the IPC (Annexure P/6).
3. Hon’ble Court may kindly be pleased to quash the
order dated 21.07.2023 (Annexure P/7) whereby learned Judicial Magistrate First Class Bilaspur has taken a cognizance of the impugned charge-sheet and registered the impugned criminal proceeding as Criminal Case No. 5269 of 2023.”

Learned counsel for the petitioners seeks permission of this Court to withdraw the present petition with a liberty to file afresh petition, as in the present case wrong final report/charge-sheet has been annexed.
4. Mr. Hariom Rai, learned Panel Lawyer, appearing for respondents No. 1 & 2/State, has no objection.
5. In view of the submission made by the learned counsel for the petitioners, the present petition is dismissed as withdrawn with the aforesaid liberty, as prayed for subject to depositing a sum of Rs. 1,000/-
4 as cost by the petitioners in the Registry of this Court within a period of one week from today and the said amount shall be transmitted to the Children Observation Home, Bilaspur.
