Present revision has been filed under Article 227 of the Constitution of India for setting aside the order dated 05.11.2024 (Annexure P-6) passed by the Civil Judge (Jr. Division), Ajnala in Civil Suit No.129 of 2020. 2. Learned counsel for the petitioner has submitted that since in the impugned order, an application for leading secondary evidence has been allowed with the specific observation that the same would be subject to proof of existence and loss of abovesaid agreement and all just exceptions of Section 65 of Indian Evidence Act, thus, the petitioner be permitted to withdraw the present revision petition with liberty to raise all pleas during the course of trial. It is further submitted that the petitioner be also permitted to raise the plea/objection that the photocopy of the agreement has been produced and all other pleas to which he is entitled. 3. Dismissed as withdrawn, with the aforesaid liberty. 4. It is made clear that all the objections raised on behalf of the petitioner would be considered by the trial Court at the time of final adjudication, after taking into consideration the entire evidence and documents on record, in accordance with law.
