The petitioner is the Secretary of Bahadajhola Swajaladhara Users Committee, (SHG) engaged in operating the pumpset providing drink\ing water to the villagers. His grievance is that as per letter dated 03.05.2024, the BDO, Nugaon who has no authority forcibly handed over charge of the pump house to the Sarpanch of the Gram Panchayat. According to the petitioner, the above action of the BDO is contrary to the guidelines. In this context, he has approached the Collector, Nayagarh by submitting a representation on 22.05.2025, copy of which is enclosed as Annexure-7. No action has been taken on such representation as yet. 3. Considering the fact that it is for the concerned authority to take a decision at the first instance, the writ application is disposed of directing the Collector, Nayagarh to consider and dispose of the Order No. 13. representation of the petitioner within four weeks from the date of production of certified copy of this order under intimation to the petitioner. It goes without saying that opportunity of hearing shall be granted to the petitioner before disposing of the representation. (Sashikanta Mishra) Judge Deepak
