2 Heard.
1. In the present writ petition the petitioner is questioning Annexure P-1 dated 04.03.2024, by which penalty of Rs. 25,000/- has been imposed on the petitioner by the C.G. State Information Commission, as the petitioner failed to provide information as sought by the information seeker.
2. Learned counsel for the petitioner submits that the impugned
order dated 04.03.2024 passed by the C.G. State Information Commission has been received by the petitioner on 14.10.2024. He further submits that the impugned order dated 04.03.2024 of the Information Commission is illegal and without providing opportunity of hearing to the petitioner. He also submits that no notice has been issued to the petitioner before imposing penalty of Rs. 25,000/-.
3. Learned counsel for the respondent submits that the impugned
order has been passed by the C.G. State Information Commission after considering the facts of the case in detail. Hence, there is no illegality in the order.
4. I have heard learned counsel for the parties and perused the documents attached.
5. Perusal of the impugned order dated 04.03.2024, shows that before passing of the order no opportunity of hearing was given
3 nor notice was severed to the petitioner, which is in violation of the principles of natural justice.
6. Considering the aforesaid facts, the writ petition is allowed and the impugned order dated 04.03.2024 is set aside. The case is remanded back to the C.G. State Information Commission and it is directed to pass a detailed order after giving opportunity of hearing to the petitioner. Sd/-
