1. The Court made the following ORAL ORDER:
Heard Sri N. Ravi Prasad, Ld. Counsel appearing on behalf of Sri Mudunuri Anand Kumar, Ld. Counsel for the Writ Petitioner and Ms. Santhi Chandra, Ld. Standing Counsel for the APIIC. 2. This Court has taken note of the Common Order passed by this Court on 10.11.2025 in W.P.Nos.30154 and 30423 of 2025. Ld. Counsel for the Writ Petitioner as well as the Respondents has taken this Court through the 8APIIC Land Allotment Regulations-20239 issued by the Official Respondents. Ld. Counsels has drawn the attention of this Court to the Regulations 11.1 and 16.2. Ld. Counsel for the Respondents has also drawn the attention of this Court to Regulations 12.9 (b). This Court had noticed that the impugned Order of Rejection dated 23.09.2025 (Ex.P.6) is a Non- Speaking Order that does not disclose the reasons for rejection. 3. Having noted the same, this Court is of the view that the Respondents ought to have passed a Speaking Order especially when the Writ Petitioner has complied with all other conditions while submitting Application and also having deposited the required fee. It is also submitted by the Ld. Standing Counsel for the Respondents that the fee paid by the Writ Petitioner has been refunded.
Be that as it may, this Court, having expressed that the impugned order is a Non-Speaking Order, is of the view that it is a violation of Principles of Natural Justice. 4. Accordingly, the impugned Order dated 23.09.2025 (Ex.P.6) is set-aside with a direction to the Respondents to pass a Speaking Order within one week from today and communicate the same to the Writ Petitioner forthwith. However, as it is informed to this Court by the Ld. Counsels that the last date of making an Application to participate in the auction was scheduled

on 18.11.2025, and that the auction would held on 21.11.2025, this Court deems it appropriate to direct the Respondents to accept the Application of the Writ Petitioner if it submits the Application on or before 5 PM tomorrow i.e., on 20.11.2025. The Writ Petitioner shall thereafter be allowed to participate in the e-auction, which shall be subject to the final Speaking Order that would be passed by the Respondents. 5. With these observations and directions, this Writ Petition is disposed of. No order as to costs. 6.
