1. The parties are present through virtual mode from DLSA, Raigarh. The counsel for respondents also appeared through virtual mode.
2. Learned counsel appearing for the appellant has filed a docket form duly signed by the parties.
3. Present is a First Appeal filed by the appellant against the impugned
judgment and decree dated 15.10.2024 passed by the VIth Additional District Judge, Raigarh, in Civil Suit No.3-A/2022 whereby the suit filed by the appellant for specific performance of contract dated 28.01.2021 has been dismissed.
4. During pendency of the present appeal, the parties have settled their dispute and entered into a compromise in the following terms:
“The respondents/Defendants would refund the entire advance
consideration received by them pursuant to agreement dated 28.01.2021 along with interest/compensation total summing to Rs.52,80,000/- and the Appellant/Plaintiff would not file any other case with respect to agreement dated 28.01.2021 and the cause of action qua the agreement dated 28.01.2021 would come to an end for all purposes. Accordingly, in terms of the aforesaid, an award/decree may be passed and court fee/costs incurred by the parties be refunded.”

According to terms and conditions of compromise, Rs.52,80,000/- has already been paid to the appellant in lieu of advance amount paid towards the agreement as well as compensation amount and now he is waiving his right to further prosecute the agreement dated 28.01.2021. The terms and conditions have also been verified by the concerned parties appeared through virtual mode.
