VENKATA RAMA RAO KOTA, SC FOR APSPDCL The court made the following ORDER:- The writ petition was filed in the year 2017 under Article 226 of Constitution of India seeking the following main prayer:- <……declaring the inaction of the Respondents in considering and disposing of the representation Dated 17.11.2016 as being illegal, arbitrary and unconstitutional and consequently direct the Respondents to forthwith act upon the said representation dated 17.11.2016 and pass such other order or orders as may deem fit and proper in the circumstances of the case. and to pass…….= 2. The principal grievance of the petitioner having worked in the respondent Corporation as Lineman preferred a representation dated 17.11.2016 before the respondents Corporation seeking certain service benefits, etc. 3. Today when the matter is called, there is no representation for the petitioner. 4. On the other hand, learned Standing Counsel for the respondents Corporation while forwarding Memo dated 19.01.2023 issued by the respondents and death certificate of the petitioner, submits that the petitioner died on 28.02.2022 and subsequently, Smt. P. Latha, wife of the deceased 3 petitioner, was appointed as Junior Assistant with time scale and usual allowances, in the respondents Corporation. 5. Having regard to the submissions made with reference to Memo dated 19.07.2023 of the respondents Corporation and in the absence of representation from the side of the petitioner, this Court is of the opinion that no further orders are required in the present writ petition any more. 6. Accordingly, the writ petition is closed. However, this Order does not preclude the legal representatives of the deceased petitioner from availing the remedies available in Law, if so advised. There shall be no order as to costs.
