Learned counsel for the petitioner submits that the petitioner is the absolute owner and possessor of the lands in Sy.No.275-13 to an extent of Ac.0.121/2 cents and Sy.No.275-16A, admeasuring to an extent of Ac.0.61i/2

3 cents at Kistupuram Revenue Village, Kotabommali Mandal, Srikakulam District, through a family settlement vide settlement deed dated 28.03.2023. Since then, he has been in possession of the subject property. The
learned counsel for the petitioner further submits that the
4. petitioner’s father name was mutated in the revenue records as pattadar in respect of the subject lands and an endorsement vide Rc.No.68/2023, dated 22.12.2023 was issued by the 4^*^ respondent by conforming the same. But, due to the resurvey conducted recently by the revenue officials, the name of the petitioner was not considered and mutated in respect of the subject lands. For which, the petitioner submitted a representation to the 4*'^ respondent on
21.10.2024. Even after having partition between the brothers on succession of property from their father, the respondents neither mutated the name of the \ petitioner nor issued any other proceedings. Hence, the Writ Petition. On the other hand, the learned Assistant Government Pleader for

Revenue furnished a copy of written instructions issued by the 4'^ respondent vide Rc.No.481/2025 A, dated 19.04.2025, wherein, the relevant paragraphs are extracted hereunder: / further submit that the petitioner Sri Datia Parinaidu S/o Late Yerramnaidu has submitted representation to this office for issuance of pattadar passbook for the land for an extent of Ac 0.12 y2 cents in Sy.No 275-13 and extent of Ac 0.61 >2 cents in Sy.No. 275-16A of Kistupuram Village, despite the fact there is an existing partition dispute between the petitioner and his daughters over the said land. It is further submitted that the petitioner has only submitted representations for issuance of pattadar passbooks for the land for an
4 extent of Ac 0.12 in Sy.No 275-13 and extent of Ac 0.61 >2 cents in Sy.No. 275-16A of Kistupuram Village and accordingly an endorsement was issued to the petitioner i.e., Sri Datia Perinaidu S/o Yerramnaidu informing for applying for mutation application through GSH^S / Mee- Seva. But the petitioner has not applied for the mutation application through GS14/S / Mee-Seva so far, which is the valid process of applying for mutation. \ \ Having regard to the submissions made by the learned counsel for the
6. petitioner and the learned Assistant Government Pleader for Revenue, this f Court is of the view that the dispute pertains, is to the manner in which the petitioner has sought relief, specifically, whether such relief can be requested through a representation or through an application under Form 6A, as contemplated under the Rules. 7.
In response, learned counsel for the petitioner submits that in view of the resurvey, the petitioner is unable to make an application in Form 6A, as required. As such, he submitted a written representation to the respondents. 8. In view of the same, this Court is of the considered view that the present th Writ Petition can be disposed of directing the petitioner to approach the 4 respondent and to submit that either 6A application or detailed representation along with payment particulars of requisite fee within a period of two (02) weeks from the date of receipt of a copy of this Order. After the receipt of the same, the 4**^ respondent herein is directed to consider the same and pass a speaking
order after providing an opportunity of personal hearing to the petitioner and other stake holders, if any, within a period of two (02) months thereafter.
