Learned State counsel submits that advance copy of the appeal has already been given to Mr. Sushobhit Singh, learned counsel, who ANURADHA TIWARI Digitally signed by ANURADHA TIWARI Date: 2025.02.13 10:13:37 +0530 2 appeared on behalf of the writ petitioner/respondent herein before the learned Single Judge. 3. When the matter is called out for hearing, Mr. Sushobhit Singh, learned counsel for the writ petitioner/respondent herein is not present. 4. The present intra Court appeal has been filed by the appellants against the order dated 05.09.2024 passed by the learned Single Judge in WPC No.3983 of 2024 (Santoshi Gond vs. State of Chhattisgarh & another), whereby the learned Single Judge has allowed the writ petition filed by the writ petitioner/respondent herein. 5. It has been pointed out by learned counsel for the appellants/State that in an identical matter, this Court had dismissed Writ Appeal No.714 of 2024 (State of Chhattisgarh & another vs. Smt. Priyadarshani Singh Nahrel & Others) and other connected matters vide order dated 12.12.2024 observing as follows : “26. In view of the above discussion, we are in disagreement with the observations and findings arrived at by the learned Single Judge and as such, the order dated 28.08.2024 passed by the learned Single Judge in WPC No. 3459/2024 and connected writ petitions, are quashed and the appeals filed by the appellant/State are allowed. Consequently, the writ petitions filed by the writ petitioners viz. WPC No. 3459/2024, 3 3484/2024, 3464/2024, 3572/2024 and 3594/2024, stand dismissed.” He further submitted that since the facts and issue involved in the present case is identical to that of Writ Appeal No.714 of 2024, this appeal may also be disposed off in the same terms. 6. Having considered the rival submissions made by learned counsel for the appellants and having gone through the materials on record, it is evident that the facts and issue involved in this appeal is identical to Writ Appeal No.714 of 2024, this Court deems it appropriate not to take a view other than what has been taken in Writ Appeal No.714 of 2024. 7. Accordingly, the present appeal is dismissed in terms of the order dated 12.12.2024 passed in Writ Appeal No.714 of 2024 (State of Chhattisgarh & another vs. Smt. Priyadarshani Singh Nahrel & Others). Sd/- Sd/- (Ravindra Kumar Agrawal) (Ramesh Sinha) Judge Chief Justice Anu
