JUSTICE DEEPAK ROSHAN ----------- For the Petitioner : Mr. Ranjan Kumar Singh, Advocate Mr. Swami Nath Prasad Rai, Advocate For the Respondents : Mr. Suman Marandi, AC to SC-IV ---------- 02/ 23.06.2025 In the instant writ application, the petitioner has prayed for direction upon the respondents to pay and provide ACP/MACP benefits to the petitioner forthwith on account of the fact that though he retired from service on 31.05.2018 from the post of Live Stock Assistant (Class-III), yet the benefits have not been extended to him. 2. At the outset, learned counsel for the petitioner submits that instant application may be disposed of by directing the concerned respondents to consider his case in view of Annexure-4 to the writ application. 3. Learned counsel for the respondents submits that since no counter- affidavit has been filed, as such, the petitioner may be directed to file fresh representation before the respondent No. 3, who shall decide the case in accordance with law. 4. Having regard to the aforesaid facts and circumstances, the instant writ application is hereby disposed of by directing the 3rd Respondent to 2025:JHHC:16486 2 treat this writ application as representation and take a decision with regard to the claim made by the Petitioner in accordance with law and applicable rules and regulations as well as Annexure-4 to the writ application, by passing reasoned and speaking order within a period of 12 weeks from the date of receipt of a copy of this order. 5. The Petitioner is directed to serve a copy of this writ application to the concerned respondent so that his grievance can be redressed at the earliest. 6. With the aforesaid observations and directions, the writ petition stands disposed of. (Deepak Roshan, J.) kunal/-
