ORDER:
This Writ Petition is filed under Article 226 of the Constitution of India for the following relief:
“….to issue an appropriate writ or order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the 3rd Respondent in interfering with the petitioner's possession and enjoyment over the land to an extent of 1200 Sq Yards of open land situated in Sy.Nos.303/9 and 10 of Kanithi Village, G.V.M.0 Limits, Gajuwaka Mandal, Visakhapatnam District at the instance of the Respondents 4 and 5 while pendency of civil litigation in O.S.No.188 of 2019 pending on the file of Junior Civil Judge Court, Gajuwaka as highly illegal, arbitrary and contrary to Articles 21 and 300A of the Constitution of India and issue consequential directions to the 3rd Respondent not to interfere with the civil dispute of the Petitioner and the Respondents 4 and 5 in respect land to an extent of 1200 Sq Yards situated in Sy.Nos.303/9 and 10 of Kanithi Village, G.V.M.C Limits, Gajuwaka Mandal, Visakhapatnam District in any manner and to pass…”
2. Heard learned counsel representing Sri P.Raj Kumar, learned counsel for the petitioner and Sri R.Mallikarjuna Rao, learned Assistant Government Pleader for Home. 3. Learned Assistant Government Pleader for Home already submitted that the preliminary enquiry conducted by the police revealed that the impugned dispute is purely civil in nature, and therefore, police will not interfere in this matter. 4. The submissions made by the learned Assistant Government Pleader for Home are placed on record. 5. In that view of the matter, this Court is of the considered opinion that no further orders are required in the writ petition. 4
