Hon'ble Arindam Sinha,J. Hon'ble Avnish Saxena,J. 1. Mr. Sanjeev Kumar Saxena, learned advocate appears on behalf of petitioner and submits, his client is widower. His wife died in a road-accident. She was cultivating the land as his client is completely blind. His client is entitled to receive compensation under the scheme, 'Mukhyamantri Kisan and Sarvhit Beema Yojana'. The insurance company wrongfully rejected claim on the policy by letter dated 28th December, 2017. The scheme empowers the District Magistrate to still look into the claim, direct and disburse the compensation. He refers to paragraph-5 of the scheme. He submits, there be direction upon the District Magistrate to consider his client's application dated 25th February, 2019. 2. Mr. Ambrish Shukla, learned advocate, Additional Chief Standing Counsel appears on behalf of State and submits, the scheme is in respect of insurance. The insurance company has rejected the claim. The writ petition be dismissed. 3. We do see that the scheme by paragraph-5 in it empowers the District Magistrate to look into the claim in spite of rejection on the insurance policy. As such, respondent no.2 is directed to consider petitioner's application dated 25th February, 2019. Petitioner will communicate certified copy of this order along with copy of the application to said respondent. Either disbursement of the compensation is to be made or reason for rejection of the application informed to petitioner within four weeks of the communication. 4. The writ petition is disposed of.
