(Oral) CM-7447-CWP-2025 in CWP-26894-2018, CM-7458-CWP-2025 in CWP- 29033-2018, CM-7459-CWP-2025 in CWP-11869-2019 and CM-7452- CWP-2025 in CWP-26371-2018 Present applications have been filed for recalling the order dated 02.05.2025, by which, the present writ petitions were dismissed for non- prosecution. Notice of the application to the counsel opposite. Mr. Harkirat S. Jagdev, Advocate for Mr. Aalok Jagga, Advocate appears on behalf of respondent No. 4 in all the applications and raises no objection for the grant of prayer as raised in the present applications. Keeping in view the averments made in the applications, which are duly supported by the affidavits, the same are allowed. The order dated 02.05.2025 is recalled and the writ petitions are restored to their original numbers and status. CWP-26894-2018, CWP-29033-2018, CWP-11869-2019 and CWP-26371- 2018 1. In the present bunch of petitions, the details of which have been given in the heading, the grievance being raised by the petitioner is with Kanchan 2025.05.28 17:53 I attest to the accuracy and integrity of this order/judgment CM-7447-CWP-2025 in/and CWP-26894-2018 and other connected cases 3 regard to the disciplinary proceedings which have been initiated against him. The claim of the petitioner is that he should be allowed the assistance of an Advocate and further, the complainant, on whose complaint the disciplinary proceedings have been based upon, should be recalled to be cross-examined. 2. Learned counsel for the petitioner submits that as of now, the petitioner is only pressing his prayer with regard to recalling of the complainant for cross-examination by giving him one opportunity and the other prayer in the other petition be treated as not pressed. 3. Learned counsel appearing on behalf of respondent No. 4 submits that the matter is pending since long and as the petitioner is only pressing his prayer for recalling the complainant for cross-examination by giving him one opportunity, no objection is raised by the respondent No. 4 qua the said prayer. 4. Keeping in view the fact that the parties are agreed that in case, one opportunity to cross-examine the complainant is given to the petitioner, the disciplinary proceedings pending against the petitioner can be taken to the logical end. The Enquiry Officer is directed that the complainant be called for a particular date with the advance notice to the petitioner and he be given opportunity to cross-examine the said complainant. In case, the petitioner does not avail the said opportunity given to him, no further opportunity will be given to him for the said purpose. 5. The present petitions are disposed of in above terms. 6. Pending miscellaneous application, if any, also stands disposed of.
