By the present writ petition, the petitioner is questioning the order dated 18/09/2024 Annexure P-1, by which, the application of the petitioner for correction of date of birth in the mark-sheet/certificate of the High School Certificate Examination (10+2), 2013 issued by the Chhattisgarh Board of Secondary Education, Raipur in the month of March 2013, has been rejected. Learned counsel for the petitioner submits that the petitioner has moved an application on 21/02/2024, however, the said application has been rejected by the Board vide Annexure P-1 observing that as per the provisions/guidelines of the Board, the application can only be considered within a period of three months from the date of issuance of the mark-sheet. He further submits that the petitioner has passed Class 5th Examination in 2008 & in 2011, he passed the Class 8th examination and in both the mark-sheets, date of birth of petitioner were recorded as 27/07/1996. 3. Learned counsel for the respondent/Board submits that the application moved by the petitioner was after a period of 11 years from the date of issuance of the mark-sheet/certificate and as per the provisions/guidelines of Board dated 08/06/2012, the application can only be entertained within period of three years from the date of issuance of the mark-sheet/certificate, hence, the application has rightly been rejected by the Board. 4. I have heard learned counsel for both the parties and perused the impugned order dated 18/09/2024 (Annexure P-1). 5. From perusal of the impugned order dated 18/09/2024, it appears that the application for correction of date of birth in the mark- sheet/certificate has been moved by the petitioner only on 21/02/2024 i.e. after a period of 11 years from the date of issuance of the mark-sheet/certificate.
By referring the guidelines, the Board has rejected his application stating that the application for correction can only be entertained within a period of three
3 / 3 years but as the application has been filed by the petitioner beyond the said period, the application has been rejected. Hence, there is no illegality found in the order passed by the Board, however, if the petitioner so desires, he can challenge the circular/guidelines of the Board before the appropriate authority or forum
6. Accordingly, the present writ petition is disposed of with the aforesaid liberty. SD/-
