Heard the submissions of the learned counsel for the petitioner and the learned Assistant Public Prosecutor appearing for the State. 2. The petitioner was arraigned as A.3 in Crime No. 127 of 2024 of Rapthadu Police Station, Ananthapuramu District, registered for the alleged offences under Sections 308(4), 126(2) read with 3(5) of the Bharatiya Nyaya Sanhita, 2023 on the complaint of the 2^^ respondent. 3. The learned counsel for the petitioner submits that there was a difference in the financial transaction between the petitioner’s family and the 2^^ respondent, the mother of the petitioner, has filed a complaint before the Ananthapuramu III Town Police Station, Ananthapuramu District, in Crime No. 168 of 2024 and in retaliation, the 2'^^ respondent has filed the present complaint against the petitioner and the family members. 4. The veracity of the allegations made in the complaint would come to light during the course of the investigation. At this juncture, the Court is not inclined to interfere in the investigation. Furthermore, the offences alleged against the petitioners would attract a punishment of less than seven years. 5. Therefore, the Station House Officer, Rapthadu Police Station, Ananthapuramu District, is directed to follow the procedure as CRLP. No.4707 of 2025 contemplated under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023, insofar as the petitioners are concerned, for the purpose of investigation in connection with Crime No. 127 of 2024. This order would not preclude the investigation officer from filing a charge sheet or final report after completion of the investigation. Accordingly, the criminal petition is disposed of.
