Call for records in C.C No: 39688/2024, for alleged offences under sections 506, 34, 504, 429, 448 and 341 of Indian Penal Code, 1860 and Sections 11 of the Prevention of Cruelty to Animals Act, 1960, pending on the file of the Hon’ble 9th Additional Chief Judicial Magistrate, Bengaluru City. b. Quash the FIR, Complaint, Chargesheet and entire proceedings C.C No. 39688/2024, for alleged offences under sections 506, 34, 504, 429, 448 and 341 of Indian Penal Code, 1860 and Sections 11 of the Prevention of Cruelty to Animals Act, 1960, pending on the file of the Hon’ble 9th Additional Chief Judicial Magistrate, Bengaluru City in so far as the Petitioners are concerned. c. Grant such other relief/s as this Hon’ble Court deems fit to grant in facts and circumstances of the case.” 2. Learned counsel for the petitioners – accused Nos. 1 to 5 and 7 to 9 and learned counsel for 2nd respondent – complainant have filed a Joint Memo dated 24.02.2025 duly signed by petitioner - 5 - NC: 2025:KHC:8405 CRL.P No. 2502 of 2025 No.7 on behalf of all the petitioners, 2nd respondent and their respective counsel. The same is taken on record. 3. Petitioner Nos.4 and 6 and respondent No.2- complainant are physically present before the Court and they admit the contents of the aforesaid Joint Memo, which reads as under:- “JOINT COMPROMISE MEMORANDUM OF BOTH PARTIES The Counsels for petitioner and Respondent No.2 respectfully submits as follows: 1. It is submitted that the complainant/ Respondent No. 2 in C.C.No.39688/2024 and the Petitioners herein have amicably settled all their disputes. 2. It is submitted that, the offences in the present case under Section 341, 448, 429, 504 & 506 of India penal Code, 1860 and Sections 11 of the Prevention of Cruelty to Animals Act, 1960 are compoundable in nature. In view of the same as the dispute has been fully settled, and no further issues remain between the Petitioners and the Complaints/ Respondent No.02. Wherefore, in view of the above, it is respectfully prayed that this Hon’ble Court be pleased to Quash the Complaint, FIR, and the entire proceedings in C.C.No.39688/2024 for offences under Section 341, 448, 429, 504 & 506 of Indian Penal Code, 1860 and Sections 11 of the Prevention of Cruelty to Animals Act, 1960 on the file of the Hon’ble 9th Additional Chief Judicial Magistrate, Bangalore City, Bengaluru.” - 6 - NC: 2025:KHC:8405 CRL.P No. 2502 of 2025 4. In view of the aforesaid settlement entered into between the petitioners and 2nd respondent, I pass the following: ORDER (i) Petition is disposed of in terms of the Joint Memo dated 24.02.2025. (ii) All further proceedings in C.C.No.39688/2024 arising out of Crime No.272/2024 registered by the 1st respondent – Police for the offences punishable under Sections 506, 34, 504, 429, 448 and 341 of IPC and Section 11 of the Prevention of Cruelty of Animals Act, 1960, pending on the file of 9th ACJM, Bangalore, insofar as the petitioners are concerned are hereby quashed.
