Order:- This Criminal Petition under Sections 480 and 483 of BNSS, has been filed by the petl'tioner herein/Al seeking regu`Iar bail in Crime No.42 of 2025 of Anakapalli Rural Police Station, registered for the offences punishable under Sections 20(b)(ii)(B)I 25 read with 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985.
2. Case of the prosecution, in brief is that on 22.02.2025, on receipt of credible information about illegal transportation of ganja, the sub- Inspector of police along with his staff and mediators +ushed to Kunchangi Junction of Anakapalli Mandal and caught Al to A5 in possession of 8 Kgs of Ganja. The contraband along with other material was seized under the cover of mediators report.
3. Learned counsel for the petitioner contends that the petitioner has been in J-udiCial custody from 22.02.2025 and prays this Court to grant bail to the petitioner herein. He further submits that A2 to A5 in the present crime were granted bail by the Special Court vide order dated 02.04.2025 in Crl.M.P.No.580 of 2025. In support of his contention, he placed a copy of the said order before this Court.
4. On the other handJ learned Assistant Public Prosecutor vehemently opposed the grant of bail to the petitioner on the ground that t- |..39 investigation in the present crime is not completed. Li_=_I +

6. Learned counsel for the petitioner subml-tted that the contraband alleged to be seized from the possessl-on of the petl-tioner herein and others is 8 Kgs of ganja, whI-Ch iS not Of commercial quantity. Moreover, A2 to A5 were granted ba" by the specI'aI Court and the case of the present pe{jtioner is also on the same footing that of other accused. It is submitted that the petI-tl'Oner had permanent abode and there I'S nO possibI'Iity of his fleeing away from the J'uStjCe. lt l's submI-t{ed by the
learned counsel for the petI'tiOner that most of the wI-tneSSeS are shown to be offJ'Cial WI'tneSSeS and the release of the accused would not cause hampering of I'nVeStigatjon and tamperjng of witnesses.
7. ln view of{he aforesaI-d facts and cl-rcumstances of the case and sl-nce the contraband I'nVOIved in the present crime js not a commercial quantity, thI-S Court l's I-ncII®ned to grant ba" {o the pe{jtjoner herel-n.
