By the present Writ Petition, the petitioner is seeking the directions toward respondent No. 3 to provide all the information which was sought by him in terms of the order passed by the RAHUL JHA Digitally signed by RAHUL JHA Date: 2025.01.08 10:42:12 +0530 2 State Information Commission, Raipur (C.G.). 2. Learned counsel for the petitioner submits that vide communication dated 27/08/2024, the First Appellate Officer/ Additional Commissioner directed the petitioner to remain present in the office on 03/09/2024. However, the said notice/intimation/communication sent by respondent No.3 was received by the petitioner on 05/09/2024. He submits that from the envelope by which the intimation/communication was sent, shows that it was dispatched on 04/09/2024. As the intimation/communication letter was not communicated properly to the petitioner, therefore, he could appear before the office of Additional Commissioner. 3. On the last date of hearing, counsel appearing for respondent No. 2 & 3 was directed to seek instructions from the respondents. Today, learned counsel for respondent No. 2 & 3 informed that they are ready to comply with the directions of the Information Commission and they will again grant time to the petitioner to disclose the information sought by him. 4. I have heard counsel for the parties. 5. On perusal of the communication letter dated 28/07/2024, it is revealed that the petitioner was directed to remain present in the office of Additional Commissioner on 03/09/2024, however, from the envelope by which the communication was sent shows that the same was dispatched on 04/09/2024 and it was received by 3 the petitioner on 05/09/2024 and as such the petitioner could not appear before the Additional Commissioner. Therefore, it is directed that the respondents shall issue a fresh communication/intimation to the petitioner directing him to appear before the office for perusal of the information sought by him. It is also directed that on receiving the communication/intimation, the petitioner shall appear before the Authority concerned and shall look into the information sought by him. 6.
