The petitionerswas arraigned as A.1 and A.2 in Crime No. 19 of 2025 of Chilamathur Police Station, Sri Sathya Sai District, registered for the alleged offences under Sections 126(1), 351(2) read with 3(5) of the Bharatiya Nyaya Sanhita, 2023, on the complaint of the 2"^^ respondent. 3. The learned counsel for the petitioners submits that the dispute between the petitioners and the 2"^^^ respondent is civil in nature, and the 2"^ respondent, without approaching the civil court, has initiated criminal proceedings to harass the petitioners. 4. The veracity of the allegations made in the complaint would come to light during the course of the investigation. At this juncture, the Court is not inclined to interfere in the investigation. Furthermore, the offences alleged against the petitioners would attract a punishment of less than seven years. 5. Therefore, the Station House Officer, Chilamathur Police Station, Sri Sathya Sai District, is directed to follow the procedure as contemplated under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023 insofar as the petitioners are concerned, for the purpose of investigation in connection with Crime No. 19 of 2025. This order would not preclude CRL.P. No.4793 of 2025 the investigation officer from filing a charge sheet or final report after completion of the investigation. 6. Accordingly, the criminal petition is disposed of. 7. Miscellaneous petitions, if any, pending in the criminal petition shall stand closed.
