THE HONOURABLEl'SRI JUSTICE K SREENIVASA REDDY CRIMINAL PETITION NO: 686 OF 2025 ORDER: _ This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A2, seeking bail in Cr'lme No.155/2024 of Mangalagiri SEB, Guntur SEB. 2. A case has been registered aga®lnSt the Pet'ltiOner and Others for the offence under sections 20(b)(ii)(C) r/w 8(c) of the Narcotic Drugs and psychotropic substances Act (for short tithe NDPS Act). 3. The case of the Prosecution, in brief, iSthat: on o9.08.2024, on credible information, the Special Enforcement Inspector, Mangalagiri, along With h®lS Staff and mediators, rushed tO Kaza toll plaza, Mangalag'lri, and Started conducting Veh'lCle Checking and found two cars containing 230.565 Kgs of Ganja and also arrested Al to A5. The contraband along With Other material Was Seized under the cover of med'lators report and the accused were arrested on the same day ®l.e. on 09.8.2024. 4. Heard. PerusedthereCOrd. 5. Leamed Assistant Public Prosecutor Submits that major Part Of the investigation is completed except filing of charge sheet. \ _ L`==-~ 2 6. Without going intof,the merits of the case, the petitioner was arrested on 09.8.2024 and since then he is languishing l'n jail l'.e. for more than 180 days as on today. Police have not completed the investigation and filed the charge sheet. As such the petitioner is entitled for default bail. 7. ln view of the aforesaid facts and circumstances of the case, this Court is inclined to grant bail to the petitioner herein, on the following conditions. (i) The petitioner/A2 herein shall be released on his executing a personal bond for Rs.10,000/-(Rupees ten thousand only) wI'th two sureties for the like sum each to the satisfaction of the Additional Judicial Magistrate of First Class, Mangalagiri; (ii) on +elease, the petitioner shall appear before the station House Officer concerned once in a week i.e. on every sunday between 10.00 a.m. and 05.00 p.m., till filing of charge sheet. 8.
