JUSTICE SHIVASHANKAR AMARANNAVAR ORAL ORDER This petition is filed by accused No.1 under Section 483 of BNSS praying to grant bail in Crime No.299/2025 of T.Narasipura Police Station registered for offences under Sections 109, 352 read with 3(5) of BNS and Section 75 of Juvenile Justice Act, 1986. 2. Heard learned counsel for petitioner and learned Additional SPP for respondent/State. 3. Learned counsel for petitioner would contend that accused No.2 is the wife of complainant. There was illicit relation between accused No.1 and accused No.2. The child of accused No.2 was found tied with thread on its private part. He submits that medical certificate indicates - 3 - HC-KAR NC: 2025:KHC:47420 CRL.P No. 14273 of 2025 that it is an insect/ant bite. In order to harass this petitioner as he is having illicit relation with accused No.2, a false complaint has been lodged against him. The petitioner is in judicial custody since 06.09.2025 and therefore, he is not required for custodial interrogation. The offence alleged against the petitioner is not punishable either with death or imprisonment for life. The petitioner is ready to co-operate with the police in further investigation. With this, he prayed to allow the petition. 4. Per contra, learned Additional SPP would contend that the child was examined by the Doctor and Doctor has opined that the injury sustained by the child is a simple injury and there are no chances of causing death if thread is tied to the private part of the child. The case is still under investigation. With this, she prayed to reject the petition. - 4 - HC-KAR NC: 2025:KHC:47420 CRL.P No. 14273 of 2025 5. Having heard the learned counsels, the Court has perused the FIR, complaint and other materials placed on record. 6. The accused No.2 is the wife of complainant. It is alleged that this petitioner is having illicit relation with accused No.2. As per averments in the complaint, accused No.2 and her child were in the house of this petitioner. When complainant took his wife and child and went to his native place in a car, he found a thread was tied to the private part of the child. It is alleged that this petitioner has done the said act in order to kill the child. The doctor who examined the child has noted that the injury sustained by the child is a simple injury and by tying a thread to the private part of the child, death will not be caused. The matter is under investigation. The petitioner has undertaken to co-operate with the police in the investigation. The petitioner is in judicial custody since 06.09.2025 and therefore, he is not required for further - 5 - HC-KAR NC: 2025:KHC:47420 CRL.P No. 14273 of 2025 custodial interrogation. The petitioner is not having any criminal antecedents. 7. Considering the above aspects, the petitioner has made out case for grant of bail with conditions. In the result, in the following: ORDER The petition is allowed. The petitioner is granted bail in Crime No.299/2025 of T.Narasipura Police Station subject to following conditions: (i) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees one lakh only) with one surety for the like-sum to the satisfaction of the jurisdictional Court. (ii) The petitioner shall not tamper the prosecution witnesses either directly or indirectly. (iii) The petitioner shall co-operate with the IO in further investigation. - 6 - HC-KAR NC: 2025:KHC:47420 CRL.P No. 14273 of 2025 (iv) The petitioner shall attend the trial Court on all dates of hearing unless exempted and co-operate, for speedy disposal of the case.
