Neutral Citation No. - 2025:AHC:113472 Court No. - 32 Case :- WRIT - C No. - 11877 of 2025 Petitioner :- Rajeev Kumar Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Rajesh Kumar Counsel for Respondent :- C.S.C. Hon'ble Chandra Dhari Singh,J. 1. The instant writ petition has been filed with the following main relief:- "(1) issue a writ, order or direction in the nature of Mandamus directing the Respondents to re-examine the paper of Code No.2608, namely, Bio- Chemistry and Clinical Pathology of the petitioner from the other examiner of the other recognized institute according to booklet paper Answer-sheet, so that justice may be done;" 2. On earlier occasion i.e. 29.04.2025, the predecessor Bench had directed to the State Counsel to obtain an expert opinion upon the answers given by the petitioner in the answer-copy of Biochemistry and Clinical Pathology of Special Back Paper Examination, 2024 (Board of Technical Education, Uttar Pradesh, Lucknow). 3. In view of the above order, Sri R.P. Tiwari, learned Standing Counsel appearing for State-respondents received an expert opinion in the sealed cover envelop and placed before this Court, the same has been taken on the record. 4. Perused the expert opinion. 5. From perusal of the same, it reveals that the Expert has reached at the conclusion that after recalculation of the marks of the petitioner in Special Back Paper Examination is correct. 6. In the instant writ petition the specific prayer of the petitioner for issuance of a writ, order or direction in the nature of mandamus directing the respondents to re-examine the paper of Biochemistry and Clinical Pathology of the petitioner from other examiner or any recognized institute, the limited prayer for issuance of mandamus as stated above has already been satisfied after getting an expert opinion. 7. Taking into consideration of the expert opinion, I do not find any reason to keep the matter pending and also do not find any ground for issuance of writ of mandamus as prayed by the petitioner. 8. The writ petition is accordingly dismissed being devoid of merit. Order Date :- 15.7.2025 Radhika (Chandra Dhari Singh, J.)
