The applicant has preferred this First Bail Application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail, as she has been arrested in connection with Crime No.825/2025, registered at Police Station – City Kotwali, Balodabazar, District – Balodabazar-Bhatapara (C.G.) for the VAIBHAV SINGH Digitally signed by VAIBHAV SINGH Date: 2025.10.14 11:29:21 +0530 2 offence punishable under Section 20(B) of NDPS Act, 1985. 2. Case of the prosecution, in brief, is that ASI Rajendra Patil, City Kotwali, Balodabazar, received secret information that Krishni Bai, Village Rishda has kept Ganja (Cannabis) in her house and on the basis of the said information, City Kotwali, Balodabazar, SHO along with other staff reached the spot and seized 1 Kg 200 gm ganja from the possession of the applicant, thereafter, case was registered against her. 3. Learned counsel for the applicant submits that applicant is an innocent person who has been falsely implicated in this case. It is submitted that the Balodabazar Police has not complied with the mandatory provisions of Sections 42, 50, and 55 of the NDPS Act, which itself is a strong ground for grant of bail. The City Kotwali, Balodabazar Police allegedly seized 1 Kg 200 gm of Ganja, out of which 50 gm was taken as a sample however, the remaining contraband was not properly deposited as required under law, thereby vitiating the entire seizure process. The only allegation against the applicant is based on the memorandum of a Juvenile in conflict with law, which is not admissible in evidence against the applicant. He further submits that the applicant has been in judicial custody since 28.08.2025, therefore, he prays for grant of regular bail to the applicant. 4. On the other hand, learned State counsel opposes the bail application and submitted that the applicant has been found in 3 possession of total 1Kg and 200 gm ganja and the charge-sheet has been filed in the present case. She further submits that the applicant has one previous antecedent of the year 2023 under Section 20(B) of NDPS Act in Crime No.710/2023 registered in Police Station – Balodabazar, therefore, she is not entitled for grant of regular bail. 5. I have heard learned State counsel and perused the documents available on case diary. 6. Considering the facts and circumstances of the case and upon perusal of the case diary, it is evident that on 28.08.2025, Assistant Sub-Inspector Rajendra Patil, posted at City Kotwali Police Station, Balodabazar, received specific information from an informant that one Krishna Bai Navrange, resident of village Risda, was illegally storing the narcotic substance ganja in her house. Acting upon the said information, a raid was conducted at the residence of the accused, and a substantial quantity of contraband, i.e., 1,200 kilograms of ganja, was seized from her possession. The charge-sheet further reveals that the accused had previously been involved in a similar offence registered as Crime No. 710/2023 under Section 20(B) of the NDPS Act at Balodabazar Police Station. It prima facie appears that she is habitually engaged in the illicit trade of narcotic substances. Accordingly, the applicant is not entitled to be released on bail, and the bail application stands rejected. 4 7. Accordingly, the bail application of the applicant – Krishni Bai Navrange, involved in Crime No.825/2025, registered at Police Station – City Kotwali, Balodabazar, District – Balodabazar- Bhatapara (C.G.) for the offence punishable under Sections 20(B) of NDPS Act, 1985, is rejected.
