JUSTICE RUDRA PRAKASH MISHRA ORAL ORDER 2 14-05-2025 Heard learned counsel for the petitioners and learned A.P.P. for the State. 2. The petitioners apprehends thier arrest in connection with Jehanabad Town P.S. Case No. 278 of 2024, instituted for the offences punishable under Sections 341, 323, 307, 379 and 34 of the Indian Penal Code. 3. The prosecution case, in short, is that, the petitioners along with other co-accused persons assaulted the informant by means of iron rod due to which he sustained head injury. 4. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the Patna High Court CR. MISC. No.32731 of 2025(2) dt.14-05-2025 2/3 present case. Charge-sheet has been submitted in this case. No incriminating material has been recovered from the conscious possession of the petitioners. Learned counsel for the petitioners also submits that no specific allegation has been attributed against the petitioners. The allegation levelled against the petitioners is general and omnibus in nature. It is further submitted that specific allegation of assault is against co- accused, namely, Ankit. The petitioner No. 1 bears one criminal antecedent, whereas petitioner No. 2 is a man of clean antecedent. Other co-accused has been granted regular bail by this Court vide order dated 16-04-2025, passed in Cr. Misc. No. 20693 of 2025. 5. Learned APP for the State has vehemently opposed the prayer for grant of bail to the petitioners. 6. Considering the rival submissions made by the learned counsel for the parties, let the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Patna High Court CR. MISC. No.32731 of 2025(2) dt.14-05-2025 3/3 Jehanabad Town P.S. Case No. 278 of 2024, subject to the conditions as laid down under Section 482(2) of the BNSS, 2023.
