Ajay Mohan Goel, Judge (Oral) By way of this writ petition, the petitioners have, inter alia, prayed for the following reliefs:- (i) “That by way of writ of certiorari letters dated 20.04.2022 (Annexure P-3), 25.06.2024 (Annexure P-5) and 20.12.2024, 03.01.2025, 15.01.2025, 27.01.2025, 14.01.2025 and 21.02.2025 (Annexure P-12(Colly) may kindly be quashed and set aside. (ii) That the writ of mandamus may kindly be issued to modify notification dated 03.01.2022 in the case of present petitioners. (iii) That by way of writ of mandamus the respondent department may be directed to grant and release the promotional increments to the petitioners in view of FR-22 (1) (a) (1) and rule 10 & 11 of the R&P Rules dated 12.08.1987 (Annexure P-1), which carried the higher duties and responsibilities then upon a post of JBT, in the interest of law and justice. (iv) That writ of mandamus may kindly be issued in alternative manner that the grade pay of the petitioners may kindly be 2 fixed at 4400/-Level-13 instead of Level-11 since before implementation of notification dated 03.01.2022 the present petitioners were getting grade pay of 4400/- as per the Revised Pay Rules 2009.” 2. When this case was listed on 19.08.2026, the Court passed the following order:- “At this stage, learned counsel for the petitioners has submitted that present case is similar to the case in CWP No. 5545 of 2022, titled as Gopal Krishan Vs. State of H.P. & others, which has been decided in favour of petitioner vide judgment dated 26.6.2025 passed by learned Single Bench of this High Court. He has further submitted that as per information available with the petitioner, the said judgment has either been complied with or likely to be complied with, within short span of time and, therefore, he submits that being similarly situated persons, petitioners are also entitled for similar relief. On request of learned Additional Advocate General, matter is adjourned to enable him to have complete instructions with regard to aforesaid submission made by learned counsel for the petitioners, including the status of implementation of judgment dated 26.6.2025 passed in CWP No. 5545 of 2022. Needful be done within two weeks. List for consideration on 8th September, 2026.” 3. Today, learned Additional Advocate General has handed over instructions received from Directorate of School Education dated 07.09.2026, which reads as under:- “I have the honour to submit that the above- mentioned case is pending for adjudication before the Hon’ble Court. Now the matter is ordered to be listed on 08.09.2026. In this regard it is submitted that the matter regarding implementation of the judgment dated 26,06,2025 passed in CHP No, 5545 of 2022, titled Gopal Krishan Vs State of H.P. & others, was taken un with the Government and the Government vide Letter No. EDUC-E0S/14/2026-EDU-C dated 06.08.2026 conveyed its approval for implementing the aforesaid judgment. 3 Accordingly, the necessary order has been issued by the Deputy Director, School Education (Elementary), District Una, H.P, vide Office Order No. EDN-U(E-III)Ele.CWP No,/2022-3542 dated 12,08,2026, a copy of the said order is enclosed herewith for kind perusal and record. You are, therefore, requested to apprise the Hon`ble Court accordingly.” 4. Learned Additional Advocate General submits that in light of the fact that the State has taken a decision to implement the judgment in Gopal Krishan versus State of Himachal Pradesh and others, needful will be done in the case of the petitioner also. 5. In light of this statement, these proceedings are closed. The order, in terms whereof, the case of the petitioner was rejected by the Authority is quashed and set aside and the respondents are directed to do the needful in the case of the petitioner in terms of the judgment of this Court in CWP No.5545 of 2022, titled Gopal Krishan versus State of Himachal Pradesh and others within a period of eight weeks from today. 6.
