ORDER:
1. Heard the submissions of the learned counsel for the petitioners and the 'I learned .Assistant Public Prosecutor appearing for the State.
2. The petitioners were arraigned as A.2 to 4 in Crime No.62 of 2023 of Repalle Police Station, Bapatia District, registered for the alleged offences under Sections 498-A read with 34 of the Indian Penal Code, 1860 and Sections 3 and 4 of the Dowry Prohibition Act, 1961, on the strength of the complaint of the 2'"'^ respondent.
3. It is alleged in the complaint that the petitioner, on account of the marital disputes between A.1 and the 2'^'^ respondent, the petitioners implicated in the present case. The learned counsel further submits that the offence alleged against the petitioner is punishable below 7 years and, therefore, seeks a direction to the police to follow the procedure provided under Section 41-A of the Code of the Criminal Procedure.
4. Considering the submissions of the learned counsel for the petitioner, the Station House Officer, Repalle Police Station, Bapatia District, is directed to follow the procedure as contemplated under Section 41-A of the Code of Criminal Procedure, 1973, insofar as the petitioners is concerned, for the purpose of investigation in connection with Crime No.62 of 2023. order would not preclude the investigation officer for filing charge sheet or final report after completion of the investigation.
5. Accordingly, the criminal petition is disposed of.
