The petitioner claims that she is entitled to appointment on compassionate ground. She has made a representation in this regard but to no avail. Learned Standing Counsel for the State-respondent No. 1 and Shri Harsh Vardhan Gupta, learned counsel for the respondents No. 2 and 3 contend that the petitioner does not fall within the category of dependent family members. They contend that the matter requires determination of facts by the competent authority as per law in the first instance and the claim of appointment on compassionate ground is liable to be decided by the competent authority in a reasonable time frame. In the wake of preceding discussions and without going into the merits of the case, the respondent No.3-Executive Officer, Nagar Palika Parishad Chandausi, District Sambhal is directed to decide the representation of the petitioner regarding claim of appointment on compassionate ground after noticing all legal heirs of the deceased employee, preferably, within a period of three months in the light of relevant provisions of law from the date of receipt of a certified copy of this order along with a fresh copy of the representation. With the aforesaid direction, the writ petition is finally disposed of.
