This appeal is directed against the order dated 28.10.2024 passed in MCA No. 1769/2024, arising out of Pirtand PS Case No. 16/2018 by the learned District and Additional Sessions Judge-I, Giridih, whereby and whereunder, the prayer for bail of the appellant has been rejected. It has been alleged that on a raid conducted by the police one Chunda Marandi @ Rohit Jee was apprehended and bombs and detonators etc. were recovered from the place of occurrence. Submission has been advanced by the learned counsel for the appellant that the appellant has been implicated on the disclosure made by the apprehended accused. It has further been submitted that Chunda Marandi has already been granted bail in BA No. 1434 of 2019 and similarly situated other co-accused have also been granted bail in BA No. 6995 of 2020 and Criminal Appeal (DB) No. 820 of 2022. It has been further submitted that the appellant is in custody since 12.01.2024. Learned A.P.P. has opposed the prayer for bail of the appellant and has submitted that the appellant has got several criminal antecedents. Regard being had to the manner of implication of the appellant and the fact that several co-accused persons have been granted bail, we while setting aside the order dated 28.10.2024 passed in MCA No. 1769/2024, arising out of Pirtand PS Case No. 16/2018 by the learned District and Additional Sessions Judge-I, Giridih direct the appellant be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Giridih in S.T. No. 207/2024. This appeal is allowed. (RONGON MUKHOPADHYAY, J.)
