1.PUBLIC PROSECUTOR The Court made the following.I ORDER=- This Criminal Petition has been filed by the petI-tI-Oner/A1, seeking anticipatory bail, in connection with crime No.54 of 2021 of Prohibition & Excis'e (SEB), Gurazala, Palnadu District. 2. A case has been regI'Stered against the petitioner herein and others for the offence punishable under section 34(a) of A.P.Excise (Amended) Act, 2020. 3. The brief facts of the casearethaton 29.08.2021, at8:00 a.m., as per the instructions of the SEB Officers of Guntur Dist,ict, during a raid condu`c`t;fa by the SEB SI along with the 6ZPS- rf
u 2 staff, they reached the Gurazala to Dachepalli road near the left side of the Bangalore Ayyamgari Backerty in Gurazala Village. There, they found a white-colored- Swift Dzire car bearing registration number AP-39-BS-5427, Two persons were sitting in the car, and upon observing them, the individuals attempted to escape.
However, they were detained, and it was found that they were in possession of illegal liquor bottle-s. The Sl of police seized 23 bottles of 750 ml and 192 bottles of.180 ml liquor and registered the case. 4. Heard. Perused the record. 5. Learned counsel for the petitioner submits that, based on the confessions of co-accused, the case was registered against the petitioner/Al without his involvement. Learned Assistant Public Prosecutor, while opposing the prayer of the petitioner, submits that the investigation is not complete. when ascertained the learned Assistant Public Prosecutor confirmed that the petitioner has no previous antecedents. The learned counsel for the petitioner submits that the petitioner has a permanent abode at Jagameswarapuram Village, Palnadu District, and there is no possibility of his fleeing away from the Jurisdiction of the Court. 6. ln view of the facts and circumstances of the case, since the petitioner herein is arrayed as accused No.1 basing on the confessional statement of coTaCCuSed and nO contraband Was seized from him and most of the witnesses are shown to be official witnesses and the release of the petitioner/Al would not cause hampering of investigation, this Court is inclined to grant anticipatory bail to the petitioner herein/A1. 7. [n the result, the criminal petition is allowed by granting anticipatory bail to the petitioner/Al subject to his surrender before the investigating officer concerned within two (o2) weeks from today. On such surrender, the petitioner shall be released on bail on his furnishing a personal bond for Rs.10,000/- (Rubees ten thousand only) with one surety for a like sum to the sat-ls faction of the concerned investigating officer. Upon his - release, the petitioner is mandated to adhere to the following conditions: (i) The petitioner/Al is directed to appear before the concerned investigating officer as and when required; and (ii) The petitioner/Al shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the Court or to any investigating or police officer and shall cooperate with the investigating officer. +J
