IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH CRM-M-19675-2025 DECIDED ON: 21.04.2025 KULJIT PAL JETLY AND OTHERS .....PETITIONERS VERSUS STATE OF PUNJAB AND ANOTHER
.....RESPONDENTS CORAM:
HON'BLE MR. JUSTICE SANDEEP MOUDGIL Present: None for the petitioners. Mr. Rajiv Verma, DAG Punjab SANDEEP MOUDGIL, J (ORAL) The jurisdiction of this Court has been invoked under Section 528 of BNSS, 2023 seeking anticipatory bail to the petitioners in FIR No.Nil under Section Nil, Police Station Kotwali, District Kapurthala. There is no representation on behalf of the petitioner. In compliance to the previous order dated 15.04.2025, today an affidavit of Deep Karan Singh, Deputy Superintendent of Police, Sub- Division, Kapurthala, Punjab has been filed, which is taken on record. Learned State counsel on instructions from ASI Baldev Singh informs the Court that there is no FIR registered against the petitioner and is not wanted in any case but for the reasons best known to the petitioner, the instant petition has been preferred seeking blanket bail. In the light of above statement made in the affidavit by the State and once the Law Enforcing Agency of the State is on record to say that the petitioner has not involved in any case as on date and is not wanted in any FIR, the question of maintainability of this petition does not arise. Hence, the present petition is dismissed having no cause of action.
