CORAM :THE CHIEF JUSTICE DHIRAJ SINGH THAKUR SRI JUSTICE RAVI CHEEMALAPATI DATE : 30*'’ April, 2025 PC: It appears that pursuant to various orders passed by this Court, the aggrieved parties who were stated to be encroachers over the land belonging to the Archeological Department over which the Mud Fort is stated to be existing have since approached the concerned authorities i.e., the Joint Collector who has passed an
order which is now under challenge under Section 12A of the Land Encroachment Act, 1905 before the Government. The proceedings have now been initiated at the behest of the Archeological Department before the Government.
2 HG & RC, J WP(PIL)_144_2023 In view of the fact that the parties have already availed their remedies in law, it may not be necessary to continue the present proceedings. The State shall take appropriate action based upon the conclusion of the proceedings before the authoritieswhich shall determineas to whether the land over which the Mud Fort exists actually has been encroached or not. The proceedings are accordingly closed. No order as to costs. Miscellaneous applications pending, if any, including IA.No.1 of 2024 shall stand closed.
