1. This is the first bail application filed under Section 483 of the Bhartiya Nagrik Shuraksha Sanhita for grant of regular bail to the applicant who has been arrested on 25/10/2024 in connection with Crime No. 769/2024, registered at Police Station Janjgir, District Janjgir-Champa, C.G. for the offence punishable under Sections 78, 351 (2) and 126 of ASHUTOSH MISHRA Digitally signed by ASHUTOSH MISHRA Date: 2025.01.15 16:45:50 +0530

The prosecution case in brief is that the complainant alleged that the accused/applicant used to give threats and harass her by stating that if she will not talk to him then he will throw the acid on her face. On 23/09/2024 when the complainant was heading towards her house, the applicant touched her. Thereby the offence has been committed by the applicant.

Learned counsel for the applicant would submit that the complainant and the applicant were studying together in the same school and because of their tender age there was some affair between them. He would next contend that the complaint was made by the complainant under pressure of her father. He would lastly contend that the applicant is in jail since 25/10/2024 and the charge-sheet in this case has been filed, therefore, the applicant may be released on bail.
4. Per contra, learned State counsel opposes the prayer for grant of bail.
5. Prosecutrix along with her father appeared in person before this Court and they raised no objection with regard to grant of bail to the applicant.

Considering the fact that the applicant is aged about 19 years and also considering the allegation leveled against the applicant as no overtact committed by him and the prosecturix has also given no objection with regard to grant of bail to the applicant, I am inclined to release the applicant on bail.
7. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond in sum of
3 / 3 Rs.15,000/- with one surety in the like sum to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court. SD/- (Arvind Kumar Verma)
