In spite of adjourning the matter, the respondents have not filed their counter affidavit. 3. The petitioner is a CIVIL contractor and was entrusted with various contract works under Neeru Chettu programme. The respondents have paid the work amounts and withheld amounts @ 7.5% per annum and earnest money deposits @ 2.5% per annum. Since the respondents are not releasing the withheld amount and earned money deposits, the petitioner has made a representation to the respondents on 05.06.2023 requesting to release the withheld amount and EMD amount on the ground that the works were completed three years back. Admittedly, there is no dispute with regard to execution of work and the same is evident through quality control certificates. It is the contention of the petitioner that even though the respondents 5. admitted that the petitioner is entitled to the aforesaid amount, no payment is made. The petitioner contends that such non-payment of money is clearly arbitrary and high-handed requiring the interference of this Court. 6. On the other hand, learned Government Pleader for Irrigation, while admitting about the claim of the petitioner, on oral instructions, submitted that the bills are pending for fund clearance, and prayed to pass appropriate orders. 7. In view of the submissions of learned counsel for the petitioner and learned Government Pleader for Irrigation, this Writ Petition is disposed of, with a direction to the respondents to release the withheld amounts @ 7.5% per annum and earnest money deposit amount @ 2.5% per annum to the petitioner as per the entitlement vide the judgment of the Division Bench of this Court in Writ Appeal No.724 of 2021 and batch of cases dated 12.10.2023, within a period of four (4) weeks from the date of receipt of a copy of the order.
