1.SAZID KALLUR Counsel for the Respondent(S):
1.GP FOR REVENUE
The Court made the foUowinq order: The petitioner claims that her husband Edigi Muthyalappa @ A.Muthyala Gowd was granted D-Form patta vide DAR Dis.No. 194/93, dated 13.03.1984 to an extent of Ac. 1.00 cents in Survey No.259-1 of Chennakothapalli Village and Mandal, Sri Satya Sai District. It is further case of the petitioner that since the date of assignment, her husband was in peaceful possession and enjoyment of the said land without any interruption. It is further stated that her husband filed a suit in O.S.No.241 of 1990 on the file of the Court of the learned District Munsif, Dharmavaram, against third parties when they tried to interfere with his possession. The said suit was decreed by judgment and decree, dated 20.03.1997. Subsequently, the husband of the petitioner was expired in the year 2002 and thereafter, the name of the petitioner was mutated in the revenue records and she was also issued pattadar passbooks. It is further case of the petitioner that while so, the respondents 3 and 5 orally directed the petitioner to vacate from the subject land inasmuch as the same is required for house site pattas in favour of eligible beneficieries. Despite showing the pattadar passbooks and adangals issued in her favour, the respondents 3 and 5 continued to interfere with the possession of the petitioner. In those circumstances, she caused a legal notice, dated 03.10.2022 to O'"* respondent apart from giving a complaint, dated 17.10.2022 in spandana programme.
It is further case of the petitioner that without taking any action on the legal notice/representation made by her, the
respondents are trying to interfere with her possession. Therefore, the present writ petition is filed. 2. This Court by order, dated 21.12.2022 passed an interim order directing the respondents not to interfere with the possession of the petitioner over the subject land without following the due process of law and the said interim order is subsisting till today. 3. When the matter is taken up for hearing, it is represented by the
learned counsel for the petitioner that after the interim order passed by this Court, no action is initiated against the petitioner by the respondents.
4. In view of the submissions made by the learned counsel, this Court feels that it is appropriate to dispose of the writ petition by directing the respondents not to interfere with the possession of the petitioner except in accordance with law.
5. Accordingly, the Writ Petition is disposed of. There shall be no
order as to costs. As a sequel thereto, miscellaneous petitions pending, if any. shall stand closed.
