(Oral) Prayer made in the present petition for respondents whereby higher pay scale granting to the petitio higher qualification was withdrawn and recovery of Rs. effected which this Court had stayed while admitting the petition on 20.12.2007 which was made absolute on 22.07.2008. Learned State counsel, however, rendered infructuous in view of stand taken in the affidavit of District Education Officer dated 19.05.2008 and Annexure R1, appended therewith, relevant of which reads thus: “3. That the recovery of Rs.91,828/ objection pointed out by the Deputy Controller, Finance Department, Hoshiarpur. 4. That after doing due correspondence with Deputy Director, Finance Department, Hoshiarpur and Additional Director, Finance Department, Chandigarh. The para pointed out by the Audit Party, same has been settled. Copy of the order is annexed as Annexure R1. 5. That now the petitioner has no grievance and no need to deposit the recovery as pointed out by the audit department and as prayed by the petitioner in the writ petition. 6. That the petitioner is now getting the pay as awarded by the respondents due to higher qualification.” Disposed of, however, still reserving the petitioner with a liberty to approach the respondents, in case any grievance still subsists.
