(HON’BLE SHRI JUSTICE BIBHU DATTA GURU) Order on Board 8 / 9 25/03/2025 1. Learned counsel for the petitioners submit that the Division Bench of this Court in the case of Tukaram Vs. State of Chhattisgarh (WPC No.1703 of 2015 and batch of petitions) has decided the issue raised in this petitions that for the purpose of considering cases for regularization under circular dated 5/3/2008 of the State Govt., an employee shall be deemed to continue in service from initial date of appointment where his termination order has been set aside and he has been reinstated by an award of the Labour Court. 2. Learned counsel for the State submits that the legal position is settled but the matter would require consideration on verification of facts. 3. It is an admitted fact that the petitioners were appointed prior to the year 1990 as daily wage employees and they were terminated from the services, which was challenged before the Labour Court wherein an award was passed pursuant to which the petitioners were reinstated. In view of the decision of the Division Bench in the case of Tukaram (supra), it is settled that the effect of reinstatement would be continuity in service, therefore, the petitioners case ought to be considered for regularization treating them to be a daily wage employee working continuously prior to 1990. 9 / 9 4. One of the petition from the batch of petitions of Tukaram Vs. State of Chhattisgarh i.e. WPS No. 4903 of 2014 has been assailed before the Hon’bel Supreme Court in the SLP (Civil) No. 35123 of 2017. The said SLP (Civil) was dismissed by order dated 22.01.2018 and affirmed the order passed by the Division Bench of this Court. 5. Consequently, writ petition stands disposed of permitting petitioners to submit representation before respondent authorities raising all the grounds as raised in this writ petition. If petitioners file such representation, the same shall be considered and decided by respondent authorities in accordance with law expeditiously, preferably within an outer limit of six weeks from the date of receipt of such representation, keeping in mind the order passed by the Supreme Court in SLP (Civil) No. 35123/ 2017 dated 22.01.2018 and order dated 16.5.2017 passed by Division Bench in WPS No.1703/2015 and other connected matters. 6.
