[2025:RJ-JP:44661] (2 of 4) [CRLAS-2833/2025] 109(1), 118(1) & 118(2) of BNS, 2023 and Sections 3(1)(r), 3(2) (v) & 3(1)(s) of SC/ST (Prevention of Atrocities) Act, 1989 (Amendment 2015). 2. The previous criminal appeal filed on behalf of the appellant was dismissed as withdrawn by this court vide order dated 19.09.2025 while giving liberty to renew the prayer for bail before learned trial Court after recording the testimony of medical expert who examined the injured. Thereafter, medical expert was examined and bail application was filed before the learned trial Court however, same has been dismissed vide order dated 13.10.2025 thus, this appeal has been filed. 3. It is contended by learned counsel for the appellant that appellant has falsely been implicated in this case. Counsel submits that according to the testimony of Medical expert- Dr. Kuldeep Sharma, four injuries were found on the person of the injured out of which, three injuries have been opined as simple in nature and only on the basis of surgery notes, one injury has been opined as dangerous to life. Counsel submits that it has been admitted by the said witness that injury no.4 has been opined as dangerous to life without taking opinion of the doctor who conducted the surgery. Counsel submits that injury No.4 is a 2cm long wound on the middle of the stomach and there was no cut on any nerve. It is contended that there are no criminal antecedents against the appellant and trial will take considerable time in its conclusion. Counsel submits that appellant is a young boy of 21 years old and he is in custody since 27.02.2025. Further custody of the appellant would not serve any fruitful purpose.
