By this application, the application is for seeking extension of temporary regular bail. 3. The applicant came to be arrested on 17/11/2023, in connection with Crime No.783/2023 registered with Police Station Mauda Nagpur (Rural) for the offence punishable under Sections 409, 411, 413, 420, 465, 467, 468, 471, 201 and 120B of Indian Penal Code, 1860 and Section 3 of the Maharashtra Protection of Interest of Depositors (In Financial Establishments) Act, 1999. 4. The crime is registered on the basis of the report lodged by Ramkushar Manikrao Nimbulkar alleging that he and his friends Vijay Wankhede and Nilkanth Chikhale are farmers. Ramanrao Bolla i.e. co-accused owns a warehouse at Gumthala and deals a business in paddy, 2025:BHC-NAG:1351 2 55.appp.113.25.odt pulses and other food grains like grams. One Roshan Pande, driver working with accused approached complainant Ramkrushna Nimbulkar and other farmers and informed that the Government is implementing a Scheme and granting compensation to small farmers who suffered losses and are victims of natural calamities. On the basis of the same, co-accused took complainant Ramkrushna Nimbulkar and other prosecution witnesses to bank, obtained their documents on a pretext of opening of bank accounts and the loans were obtained in their names and the said loan amounts was misappropriated by the co- accused. As far as the present applicant is concerned he was an employee of the National Commodities Management Services Limited (NCML) and worked as a Business Development Manager. During investigation, it revealed that he was employee and was instrumental to dispose of food grains which were mortgaged against the loan, and therefore, he is arraigned as an accused. He filed an application for grant of bail which was considered by this Court considering he is suffering from Cancer and he is in need of necessary treatment. Now, the application is filed for extension of interim bail which is granted to him by order dated 18/11/2024. He was released on interim bail for the period of eight weeks on imposing the conditions. 5. By this application, now it is contended that his current medical condition is that he is undergoing the chemotherapy at Government Medical College and 3 55.appp.113.25.odt Hospital, Nagpur, and therefore, he be released on interim bail by extending the earlier interim bail. The report of the Superintendent of Central Prison, Nagpur as well as from the Government Medical College and Hospital, Nagpur was called. As per the said report the applicant is undergoing the chemotherapy and he requires the said treatment for further two months. 6. Considering the report of the Government Medical College and Hospital, Nagpur, the interim bail granted to the present applicant is hereby extended for further eight weeks. 7. After eight weeks, the applicant shall surrender before the Superintendent of Central Prison, Nagpur. 8. On failure to appear before the Superintendent of Central Prison, Nagpur, the investigating agency to take appropriate steps to obtain his custody and produce him before the appropriate Court. 9. The applicant shall now seek any adjournment on the ground of his treatment as trial has not begin and the issue of identification parade shall not be disputed by the learned Magistrate. 10.
