(ORAL) By way of present petition filed under Section 482 of BNSS, 2023, petitioners seek anticipatory bail in case FIR as under: FIR No. Dated Sections Police Station 41 26.03.2025 333, 115 (2), 191 (3), 190 of BNS. Sujanpur, District Pathankot.

Learned counsel for the petitioners, at the very outset, submits that he seeks withdrawal of the present petition qua petitioners No. 3, 5 and 7 with liberty to file the same afresh with better particulars.
3. In view of the statement made by learned counsel for the petitioners, the petition qua petitioners No.3, 5 and 7 stands dismissed as withdrawn.

Learned counsel for the petitioners submits that in compliance to the order dated 08.05.2025 passed by this Court, the petitioners No.1, 2, KANIKA 2025.05.23 17:32 I attest to the accuracy and authenticity of this

2 4 and 6 have already joined the investigation and as such prayed for confirming the interim bail granted vide order dated 08.05.2025.
5. Learned State counsel, on instructions from ASI Naresh, intimates the Court that the petitioners No.1, 2, 4 and 6 have joined investigation and are neither required for further investigation nor for any custodial interrogation.
6. During the course of hearing on 08.05.2025, following order was passed:
“ Heard. After hearing the respective submissions and perusing the record, without commenting on the merits of the case, the petitioners No.1, 2, 4 and 6 are hereby directed to join investigation within seven days from today and co-operate in the same. In the event of the arrest of the petitioners, they shall be released on interim bail on their furnishing personal/surety bonds to the satisfaction of the Arresting Officer/Investigating Officer. They shall also abide by conditions as envisaged under Section 482(2) BNSS. List on 22.05.2025. Investigating Officer of the case is directed to remain present in Court on the next date of hearing along with record.”

Keeping in view the above submissions made by learned State counsel and the fact that the petitioners No.1, 2, 4 and 6 had joined the investigation consequent to the order dated 08.05.2025 passed by this Court, interim bail granted vide order dated 08.05.2025 is hereby confirmed qua petitioners No.1, 2, 4 and 6, subject to conditions as KANIKA 2025.05.23 17:32 I attest to the accuracy and authenticity of this

3 envisaged under Section 482 (2) of BNSS, 2023. Further the petitioners No.1, 2, 4 and 6 are directed to join investigation as and when required in future by way of written notice for such purpose to be served by Investigating Officer of this case upon the petitioners; they will not tamper with the evidence nor will influence the witnesses and will not leave the country without prior permission of the Court.
8. The petition stands allowed qua petitioners No.1, 2, 4 and 6 only whereas qua petitioners No.3, 5 and 7, it stands dismissed as withdrawn with aforesaid liberty.
9. It is made clear that anything contained hereinabove shall not be construed to be an expression of opinion on the merits of the case. 22.05.2025
