Mr. R.N.Yadav, learned advocate holding brief on behalf of petitioner submits, his client is being obstructed by respondent no.5, aided and abetted by the police, from re-constructing his house. Though respondent no.5 filed frivolous suit, he has not been able to obtain any order of restraint from the civil Court. His client is before Court to restrain the police from interfering with the construction. 2. Mr. Ambrish Shukla, learned advocate Additional Chief Standing Counsel appears on behalf of State and submits, these stands notice dated 20th November 2024 issued by the civil Court on the application filed for injunction. On query he submits, he does not have instruction on any restraint order passed. 3. Allegation against the police is that they are obstructing petitioner in constructing on his property. In the circumstances, we are not inclined to direct issuance of notice on respondent no.5. Instead we direct, in particular, respondent no.4 to furnish petitioner with authorization for visiting his property, if for purpose of restraining him for construction. Needless to mention, in event the civil Court passes a restraint order, it will be sufficient authorization. 4. The writ petition is disposed of. Order Date :- 22.4.2025 Abhishek Sri.
