I.A. No. CAN 3 OF 2024 ------------- This is an application for restoration of a restoration application (I.A. No. CAN 2 of 2023). Neither the prayer in the application nor in the body of the application including the paragraph no.7 thereto contains any averment with regard to the quantum of delay save and except the expression used “inordinate delay”.
2 Considering the above and for the ends of justice that, for procedural laches substantive justice shall not suffer, this application for restoration of a restoration application stands allowed subject to payment of cost of Rs.6000/- (Rupees six thousand only) to be paid to the benevolent fund, Bar Association, High Court Calcutta. Subject to above, the order dated August 8, 2023 stands recalled and the application being I.A. No. CAN 2 of 2023 stands restored to its original file with number. Accordingly, I.A. No. CAN 3 of 2024 stands allowed subject to the condition mentioned above. (Aniruddha Roy, J.)
