The challenge in this petition is made to the dismissal order dated 21.03.2022, passed by the respondent no.2/ Chief Conservator of Forest, Human Resource Development and Personnel Management, Uttarakhand. The petitioner was required to file rejoinder affidavit. Today, learned counsel for the petitioner would submit that according to para 2 of the counter affidavit that has been filed by the respondents an appeal is maintainable before the Principal Chief Conservator of Forest under Section 11 of the Uttarakhand Government Servant (Discipline and Appeal) Rules, 2003. Therefore, she seeks permission to withdraw the writ petition with a liberty to file an appeal. Permission is accorded. The writ petition is dismissed as withdrawn with the liberty as above.
