Petitioner is aggrieved for non consideration of the representation dated 05.10.2024 addressed to the Officer- in-Charge, Belghoria Police Station as also to the Commissioner of Police, Barrackpore Police Commissionerate. State has submitted a report which reflects that the petitioner was temporarily demobilized as per order of the Commissioner of Police, Barrackpore Police Commissionerate, prima facie being held guilty for insubordination, revealing sensitive police informations and lodging false complaint against senior police officers with mala fide intentions which rendered him inappropriate an unbecoming of a member of police force. An enquiry was ongoing under order of Assistant Commissioner of Police, Barrackpore and to cover up same the petitioner took shelter of a protest post on social media. Be that as it may, since the subject matter of the writ petition relate to a service dispute for removal from
2 service and learned advocate for the petitioner submits that he is covered under the West Bengal Home Guard Ordinance, 1962, petitioner would be at liberty to approach the appropriate Jurisdictional forum for his service related issues. No interference can be made by this Court. Accordingly, WPA 26015 of 2024 is disposed of. Liberty is grated to the petitioner as directed above. Report so submitted by the State be kept with the record. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
