2. Mr. Nitansh Jaiswal, learned Panel Lawyer, appearing for the State/respondent No.1 as well as Mr. Anil Gulati, learned counsel appearing for respondent No.2, are present. 3. The present petition has been filed by the petitioners with the following relief(s):-
“It is therefore prayed that this Hon'ble Court may kindly be pleased to allow this petition and pleased to quash the F.I.R. no.172/2022 dated 02.09.2022 and charge-sheet no.158/2022 dated 10.10.2022 filed against the present petitioners in which the petitioners has been falsely implicated U/s 498A, 506, 34 of I.P.C. & 4, 5 of C.G. Tonhi Pratadna Act, in the interest of justice.”

Learned State counsel as well as learned counsel appearing for respondent No.2 jointly submit that the co-accused namely Shyam Kumar Gupta has filed another petition being CRMP No.2810/2023, which came to be dismissed for want of prosecution on 14.06.2024, as none appeared to prosecute the matter on his behalf. 5. In the present case also, when the matter is taken up, none has chosen to appear for the petitioners despite repeated calls. This conduct clearly demonstrates that the petitioners are not interested in prosecuting the petition any further. 3

In such circumstances, no useful purpose would be served in keeping the matter pending. Accordingly, the present petition stands dismissed for want of prosecution. Sd/- Sd/- (Bibhu Datta Guru)
