JUSTICE E.S.INDIRESH ORAL ORDER This petition is filed under Section 24 of the Code of Civil Procedure, 1908 wherein the petitioner-wife has sought for transfer of M.C.No.779/2023 pending consideration before the VII Additional Senior Civil Judge and JMFC, Bengaluru Rural, to the jurisdictional Court at Ramadurg. 2. The respondent is served and remained absent. 3. Having taken note of the submission made by the learned counsel appearing for the petitioner-wife, that the petitioner-wife is residing at Ramadurg and has to take care of minor child and the distance between Ramadurga and Bengaluru is also more than 400 km and therefore, more hardship will be caused to the petitioner-wife to appear before the Family Court at Bengaluru regularly. It is also to be noted here that the petitioner herein has filed Crl.Misc.No.164/2024 seeking maintenance from the respondent. In that view of the matter, I pass the following: - 3 - NC: 2025:KHC-D:4539 CP No. 100233 of 2024 ORDER i) The above petition is allowed. ii) That the M.C.No.779/2023 pending on the file of the VII Additional Senior Civil Judge and JMFC, Bengaluru Rural, Bengaluru is hereby withdrawn and transferred to the competent jurisdictional Court at Ramadurg forthwith. iii) In view of disposal of the petition, pending interlocutory applications, if any, do not survive for consideration and are disposed of accordingly.
