R/13 ptSCR.A/9141/2025 ORDER DATED: 24/07/2025 IN THE HIGH COURT OF GUJARAT AT AHMEDABAD R/SPECIAL CRIMINAL APPLICATION (DIRECTION - TO LODGE FIR/COMPLAINT) NO. 9141 of 2025 ========================================================== LAXMIKANT DHARMCHAND PRAJAPATI Versus STATE OF GUJARAT & ORS. ========================================================== Appearance: MR.DARSHAN A. DAVE(7921) for the Applicant(s) No. 1 MR MANAN MEHTA, APP for the Respondent(s) No. 1 ========================================================== CORAM:HONOURABLE MR. JUSTICE HASMUKH D. SUTHAR
Date : 24/07/2025 ORAL ORDER
1. The main grievance of the present petitioner is that the mortgage deed was forged in the year 1984, and in this regard, the petitioner has already approached the appropriate authority. However, the proposed respondent has misled the Court by stating that he has produced the said document before the Court, whereas, in fact, he has not. Therefore, the petitioner has no option left except to approach this Court.
2. It is needless to say that the production of any document before the Court is not a subject matter for police investigation. However, insofar as the allegation of forgery is concerned, if the police have already investigated the grievance of the petitioner and taken appropriate action, and if the petitioner has any grievance against the police, then instead of directly approaching this Court, the petitioner has an alternative remedy available to approach the appropriate forum.

3. In view of the above and the judgment passed by the Hon’ble Apex Court in the case of M. Subramaniam vs. S. Janaki, reported in (2020) 16 SCC 728, no case is made out to pass any order. However, the petitioner is at liberty to approach the appropriate forum.
4. With the above direction, the application stands disposed of. It is clarified that this Court has not gone into the merits of the case.
